Why surcharge math is never just 3%

The number every merchant hears is 'add 3% and processing is free.' The real math has three haircuts. First, debit and prepaid cards can never be surcharged — federal rules, every state — and debit is often 30–50% of small-business card volume, so you keep paying full freight on that share. Second, your surcharge legally can't exceed your actual cost of acceptance, and in Colorado it can't exceed 2% regardless. Third, several states ban or restrict the practice entirely. The calculator applies all three so the recovery number you see is the one you'd actually experience.

That honest number is still often worth it — but sometimes a cash discount structure or a straightforward rate renegotiation recovers more with less compliance surface. The point of running the math first is knowing which one that is for your business before a program salesperson decides for you.

Common questions

How much can I legally surcharge?
The lower of your actual cost of acceptance or 3% if you accept Visa (Mastercard's cap is 4%, but accepting Visa makes 3% the practical ceiling). Colorado caps surcharges at 2% by state law. Debit and prepaid cards can never be surcharged anywhere.
Is surcharging legal in my state?
In most states yes, with disclosure requirements. It's banned in Connecticut, Massachusetts, and Maine, capped at 2% in Colorado, legally contested in Texas, and subject to strict total-price display rules in New York. Our state-by-state surcharge law guide has the details for each.
Why doesn't a surcharge make processing free?
Because debit cards — often a third to half of small-business volume — can never be surcharged, so you still pay full processing cost on that share, plus any program fees. The calculator shows your true net recovery, not the marketing version.
Surcharge or cash discount — which should I choose?
It depends on your state, your card mix, and your customers. Cash discount / dual pricing is legal in all 50 states and avoids surcharge restrictions; surcharging can be simpler where it's clearly legal. The calculator models both so you can compare real numbers.
